_The Limits of Utilitarianism _ was first published in 1982. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. Many philosophers have argued that utilitarianism is an unacceptable moral theory and that promoting the general welfare is at best only one of the legitimate goals of public policy. Utilitarian principles seem to place no limits on the extent to which society may legitimately interfere with (...) a person's liberties - provided that such actions can be shown to promote the long-term welfare of its members. These issues have played a central role in discussions of utilitarianism since the time of Bentham and Mill. Despite criticisms, utilitarianism remains the most influential and widely accepted moral theory of recent times. In this volume contemporary philosophers address four aspects of utilitarianism: the principle of utility; utilitarianism vis-à-vis contractarianism; welfare; and voluntary cooperation and helping others. Ethics and Advocacy considers the connections and differences between critical reflection or moral arguments or narratives and advocacy for particular issues regarding justice and moral behavior and dispositions. The chapters in this volume share an interest in overcoming polarizing division that does not enable fruitful give-and-take discussion and even possible persuasive justifications. The authors all believe that both ethics and advocacy are important and should inform each other, but each offers a divergent point of view on the way forward to (...) these agreed-upon ends. Our shared goal is to avoid academic withdrawal and to speak relevantly to the important issues of our day while halting--or at least mitigating--the disruptive discourse--almost shouting--that characterizes our polarized current society. This volume is a collection of essays concerned with the morality of hu man treatment of nonhuman animals. The contributors take very different approaches to their topics and come to widely divergent conclusions. The goal of the volume as a whole is to shed a brighter light upon an aspect of human life-our relations with the other animals-that has recently seen a great increase in interest and in the generation of heat. The discussions and debates contained herein are addressed by (...) the contributors to each other, to the general public, and to the academic world, especially the biological, philosophical, and political parts of that world. The essays are organized into eight sections by topics, each sec tion beginning with a brief introduction linking the papers and the sec tions to one another. There is also a general introduction and an Epilog that suggests alternate possible ways of organizing the material. The first two sections are concerned with the place of animals in the human world: Section I with the ways humans view animals in literature, philosophy, and other parts of human culture, and Section II with the place of animals in human legal and moral community. The next three sections concern comparisons between human and nonhuman animals: Section III on the rights and wrongs of killing, Section IV on the humanity of animals and the animality of humans, and Section V on questions of the conflict of human and animal interests. Current theories suggest that the brain is the sole source of mental illness. However, affective disorders, and major depressive disorder (MDD) in particular, may be better conceptualized as brain-body disorders that involve peripheral systems as well. This perspective emphasizes the embodied, multifaceted physiology of well-being, and suggests that afferent signals from the body may contribute to cognitive and emotional states. In this review, we focus on evidence from preclinical and clinical studies suggesting that afferent thermosensory signals contribute to well-being and (...) depression. Although thermoregulatory systems have traditionally been conceptualized as serving primarily homeostatic functions, increasing evidence suggests neural pathways responsible for regulating body temperature may be linked more closely with emotional states than previously recognized, an affective warmth hypothesis. Human studies indicate that increasing physical warmth activates brain circuits associated with cognitive and affective functions, promotes interpersonal warmth and prosocial behavior, and has antidepressant effects. Consistent with these effects, preclinical studies in rodents demonstrate that physical warmth activates brain serotonergic neurons implicated in antidepressant-like effects. Together, these studies suggest that (1) thermosensory pathways interact with brain systems that control affective function, (2) these pathways are dysregulated in affective disorders, and (3) activating warm thermosensory pathways promotes a sense of well-being and has therapeutic potential in the treatment of affective disorders. During the British socialist revival of the 1880s competing theories of evolution were central to disagreements about strategy for social change. In News from Nowhere (1891), William Morris had portrayed socialism as the result of Lamarckian processes, and imagined a non-Malthusian future. H.G. Wells, an enthusiastic admirer of Morris in the early days of the movement, became disillusioned as a result of the Malthusianism he learnt from Huxley and his subsequent rejection of Lamarckism in light of Weismann's experiments on (...) mice. This brought him into conflict with his fellow Fabian, George Bernard Shaw, who rejected neo-Darwinism in favour of a Lamarckian conception of change he called "creative evolution.". (shrink)

Hydraulic fracturing used to remove natural gas from the Marcellus Shale has raised environmental concerns in the region both in terms of air and water pollution. This article will examine those concerns and how the natural gas industry has responded to them. After discussing the issues related to groundwater contamination and air quality. I discuss industry responses and how the costs and harm associated with fracking could be reduced, with the knowledge that despite opposition from environmental groups, fracking will continue. (...) The hope is that more drillers will begin to operate in a socially responsible manner that will allow companies to be profitable while limiting harm to the environment and to individuals living near drilling sites. Historically labor has been central to human interactions with the environment, yet environmentalists pay it scant attention. Indeed, they have been critical of those who foreground labor in their politics, socialists in particular. However, environmentalists have found the nineteenth-century socialist William Morris appealing despite the fact that he wrote extensively on labor. This paper considers the place of labor in the relationship between humanity and the natural world in the work of Morris and two of his contemporaries, the eminent (...) scientist Thomas Henry Huxley, and the Fabian socialist Herbert George Wells. I suggest that Morris's conception of labor has much to recommend it to environmentalists who are also interested in issues of social justice. (shrink)

The paper considers Fregean and neo-Fregean strategies for securing the apriority of arithmetic. The Fregean strategy recovers the apriority of arithmetic from that of logic and a family of explicit definitions. The neo-Fregean strategy relies on a principle which, though not an explicit definition, is given the status of a stipulation; unlike the Fregean strategy it relies on an extension of second order logic which is not merely a definitional extension. "My experience is what I agree to attend to," wrote William James (1890) nearly a century ago in his Principles of Psychology. Although certainly not the first to recognize the importance of attention in man's experience--poets and philosophers throughout history have touched upon the concept in one way or another-James deserves credit for having accorded attention a central role in the systematic study of the mind. With the advancement of psychology since that time, except during the behaviorist digression, the (...) concept of attention has been an integral part of many prominent theories dealing with learning, thinking, and other aspects of cognitive functioning. Indeed, attention is an important determinant of experience from birth throughout development. This has been an implicit assumption underlying our view of cognition since the writings of Charles Darwin (1897) and Wilhelm Preyer (1888) as well as James, all of whom offered provocative insights about the developing child's commerce with the environment. Al though systematic research on attention in children was slow to pick up during the early part of this century, interest in the developmental study of attention has expanded enormously in recent years. Introduction: -/- It is likely that Boethius (480-524ce) inaugurates, in Latin Christian theology, the consideration of personhood as such. In the Treatise Against Eutyches and Nestorius Boethius gives a well-known definition of personhood according to genus and difference(s): a person is an individual substance of a rational nature. Personhood is predicated only of individual rational substances. This chapter situates Boethius in relation to significant Christian theologians before and after him, and the way in which his definition of personhood is a (...) particular answer to the question, “Jesus has two natures, a divine nature and a human nature, but is one what?” Among Greek (and Syriac) speaking theologians, the typical answer is that Jesus is one ‘hypostasis’. Among Latin speaking theologians, the typical answer is that Jesus is one ‘persona’. It is Boethius’s definition of ‘persona’ that inaugurates personhood as such in Latin speaking theology. Although the Greek and Syriac theologians that I survey come close to a concept of personhood as a distinct category, they do not have such a concept and did not need it for their theological purposes. I show that Rusticus the Deacon is an early witness to this Latin theological invention, and also show that for later Latin theologians, the rationality condition for personhood does very little metaphysical work for their Trinitarian theology or Christology. -/- Further, this chapter surveys Patristic and Medieval Christian theologians’ answers to the question, “God the Father, God the Son, and God the Holy Spirit are one God, but each is one what?” The same replies as above are typically given by Christian theologians. These two theological questions frame the discussion about personhood (and ‘hypostasis’) and put a boundary around what a satisfying account of personhood (and ‘hypostasis’) would be. -/- In contemporary philosophy, there is a lot of attention paid to the rationality condition for personhood. But if we look at the text in which Boethius defines a person, we do not find any precise criteria for it. In other texts, he says that a rational being is one compatible with (capable of) thought and free choice of the will. What we find is that detailed discussion of personhood shows up in theological questions about the Trinity and Incarnation, but not in e.g., applied ethics. The intrusion of personhood into contemporary applied ethics with a focus on detailed and disputed criteria for rationality as a condition for personhood seems to be a modern development. From a Patristic and Medieval Christian theology point of view, trying to find just the right detailed criteria for rationality in order to define personhood is a wild goose chase. This chapter makes clear another contribution that Christian theology had for personhood. Given the theological issues at play in developing a notion of personhood, Christian theologians came to posit that e.g., an individual human is a person contingently (i.e. not essentially), but God the Father, God the Son, and God the Holy Spirit are each a person essentially. The contingency for created persons is not based on whether e.g., an individual human has conscious acts (as might be the case for John Locke) but on the possibility of a divine person’s assuming e.g., an individual human nature. -/- This sampling of Christian intellectual history spans over one thousand years. I make no claim of being exhaustive. The chapter consists of six sections, where each section covers significant historical conversation partners who together represent the sorts of things that Patristic and Medieval Christian theologians where concerned with in theorizing about ‘persona’ or ‘hypostasis’. -/- 1. The main purpose of this article is to argue that Crispin Wright and Bob Hale have not succeeded in overcoming the well-known ‘Julius Caesar objection’ to their proposed definition of the phrase ‘the number of’. It is hoped that the article will also help to clarify what would actually be needed in order to overcome this objection.

'Rabbit' might be taken to divide its reference over rabbits, over temporal slices of rabbits, or undetached parts of rabbits, without significantly affecting which sentences get classified as true and which as false. This is the basis of his famous 'argument from below' to the conclusion that there can be no fact of the (...) matter as to how reference is to be divided. Putative counterexamples to Quine's claim have been put forward in the past (see especially Evans (1975, "Journal of Philosophy", LXXII(13), 343-362. By "proper name" I mean a proper name in Frege's sense, i.e., a singular term. The "problem" mentioned in the title is whether the subject-term of an existential statement can be a proper name. I concentrate on examining some of the existing attempts to define "proper name" and conclude that, whatever answer is given to the question just posed, the authors of these attempts (Dummett, C Wright and B Hale) will have to modify some of their beliefs. Although this review article is only about one book and about one man, it discloses a whole world, the world of Jerome, saint, scholar and stimulator of ascetism and of the study of the Bible. It is the merit of the book reviewed here to bring interesting insights into this other world, the emerging society of monks who were scholars and ascetic. In that world Jerome is one of the most fascinating patristic scholars. His choice for translating the Hebrew Bible (...) instead of the Greek Bible is one of the utmost examples that from time to time the conceitedness of one man wins. Williams’ book teaches us quite a lot about this man and his conceitedness. At the same time it explains us something about the Christian tradition, how asceticism could bring forth the wealth of libraries and abbeys. (shrink)

When David Souter was nominated by President Bush to the Supreme Court, he cited John Marshall Harlan as his model. It was an interesting choice. Admired by conservatives and deeply respected by his liberal brethren, Harlan was a man, as Justice William Brennan lamented, whose "massive scholarship" has never been fully recognized. In addition, he was the second Harlan to sit on the Court, following his grandfather--also named John Marshall Harlan. But while his grandfather was (...) an outspoken supporter of reconstruction on a conservative court, the younger Harlan emerged as a critic of the Warren Court's liberal expansion of civil liberties. Now, in the first biography of this important but neglected jurist, Tinsley Yarbrough provides a detailed account of Harlan's life, from his privileged childhood to his retirement and death. Yarbrough examines the forces and events which shaped the Justice's jurisprudence--his early life and often complex family relationships, education at Princeton and Oxford, his work as a prosecutor during Prohibition, Republican Party activities, wartime service in the Army Air Force, and years as one of the nation's preeminent corporate lawyers. The book focuses, however, on Harlan's years on the high bench. Yarbrough weaves together discussions of the Justice's relations with his brethren, clerks, and staff, an examination of Harlan's role in the decision-making process on the Court, and an analysis of his jurisprudence. The Justice's approach to constitutional interpretation exalted precedent, deference to governmental power, and narrow decisions closely tied to case facts; but he also accepted an evolving, creative model of constitutional construction which permitted expansive readings of constitutional rights. Yarbrough's details Harlan's close relationship with Justice Frankfurter, showing how--despite their friendship and alliance--Harlan strongly marked out his own position, both personally and judicially, on the Warren and Burger courts. And he examines the substance and significance of his dissents in such famous cases as Miranda and the Pentagon Papers. Intensively researched, smoothly written, and incisively argued, Yarbrough's biography offers an absorbing account of the life and career of a great dissenter, hailed by admirers as a "lawyer's lawyer" and a "judge's judge." Coming at a time when the high court has begun to adopt many of Harlan's principles, this account provides an essential perspective on the Court, civil liberties, and a pivotal figure in the history of both.
